These Terms and Conditions (“Terms”) govern your participation in the program offered by United State Solutions (“we,” “us,” “our”). By registering for and participating in the program, you agree to comply with and be bound by these Terms. Please read them carefully.
Program Availability and Changes:
The program is available while supplies last. We reserve the right to modify, suspend, or terminate the program at any time without prior notice. We shall not be liable if any part of the program becomes unavailable at any time or for any period.Eligibility Requirements:
To be eligible to participate in the program, you must:Be of legal age of majority in the state of Florida.Be the lawful homeowner of a single detached, semi-detached, or townhouse.Consent to a representative of United State Solutions visiting your property during reasonable hours, with prior notice and your consent, to install the product(s).Consent to Communications:
By participating in the program, you consent to United State Solutions using your provided information to contact you regarding appointment reminders, our products, services, and marketing communications via email or SMS. You may opt-out of these communications at any time by contacting us.Assessment and Acknowledgment:
Your participation in the program is based on your independent assessment of the program. You acknowledge that you are not relying on any anticipated or projected results from the program.Authorization for In-Home Visit and Installation:
You authorize a representative of United State Solutions to enter your property during reasonable hours, with prior notice and your consent, for the purpose of installing product(s). Installation requires an operational Wi-Fi network, the Wi-Fi network password, a nearby electrical socket, and a compatible mobile device.Use of Product(s):
You agree to use the product(s) in accordance with the manufacturer’s specifications and intended purpose. Any misuse may result in injury or damage. United State Solutions is not the manufacturer and is not responsible for any warranties or service related to the product(s).Disclaimer of Warranties and Liability:
Except as expressly stated in these Terms, United State Solutions makes no representations or warranties, either express or implied, statutory or otherwise, regarding the product(s) or their manufacturer, including but not limited to their adequacy, safety, workmanship, quality, legal compliance, fitness for a particular purpose, or accuracy. To the extent permitted by law, United State Solutions shall not be liable for any loss or damage arising from the installation or use of the product(s).No Recourse for Product Issues:
If the product(s) do not perform as indicated by the manufacturer or are otherwise unsatisfactory, you shall have no recourse against United State Solutions. We are under no obligation to replace or remove the product(s) from your property.Force Majeure:
United State Solutions shall not be liable for delays or failure to fulfill any obligations under these Terms due to causes beyond our reasonable control. We will notify you as soon as possible of any delays in the scheduled installation of the product(s).Privacy Policy:
United State Solutions is committed to protecting your personal information in accordance with applicable privacy laws. Our privacy policy, which describes how we collect, use, and disclose your information, is available upon request.Additional Terms for Product Operation:
You acknowledge that you may be required to agree to separate terms and conditions and privacy policies related to the operation of your product(s), including registration for the Nest mobile application or other device-connected services.Indemnification:
You agree to defend, indemnify, and hold harmless United State Solutions and its subsidiaries, affiliates, successors, assigns, and their respective directors, officers, shareholders, employees, service providers, agents, and representatives (collectively, the “Indemnitees”) from all claims, demands, losses, liabilities, costs, expenses, obligations, and damages, including reasonable legal fees, arising from or related to the in-home visit or the installation and use of the product(s), whether in accordance with the manufacturer’s instructions or otherwise. This indemnification obligation shall survive the termination of these Terms and the program.United State Solutions Protection Plan:
The United State Solutions Protection Plan (“Protection Plan”) covers only the air conditioning unit (“AC”) and its components. The Protection Plan does not cover accessory damage caused by leaks or electrical malfunctions. Additionally, Freon is not covered under the Protection Plan. The warranty provided by the Protection Plan can be voided if reasonable care is not given to the AC unit, such as regular replacement of the AC air filter, and if any modifications are made to the unit by the customer.If any repairs or modifications to our installations are performed by contractors other than those authorized by United State Solutions, this can void the customer’s Protection Plan.Governing Law:
These Terms and the program offered herein shall be governed by and construed in accordance with the laws of the state of Florida. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Florida, except where applicable law requires otherwise.By registering for the program, you confirm your consent and agreement to comply with and be bound by these Terms and our privacy policy. You also represent and warrant that you meet all the eligibility requirements set forth herein.
